You Ask, We Answer: Milrose Tackles Top FDNY Questions

Construction in New York City tends to be more complicated than in many other cities. Over the years, filings involving the Fire Department City of New York (FDNY) have consistently raised the most questions, as seen both in this newsletter and in client conversations. This month, we’ve called upon retired FDNY Battalion Chief Patrick Lyons, FDNY Coordinator Rosalina Lizama, and Production Manager Kathy Ragoo to answer many of your questions regarding FDNY filing requirements.

Fire Alarms

After the fire alarm plan is approved, how soon can I expect to schedule an inspection with FDNY?

Regular inspections scheduled through the FDNY typically take place within four to five weeks. Milrose Consultants works with the FDNY to cut this timeline down to three weeks for our clients.

Will an unpaid fire alarm inspection bill hold up the FDNY’s Letter of Approval?

No. An unpaid fire alarm inspection bill should not prevent FDNY from issuing a Letter of Approval. As reported previously, Milrose employees find that the most common fire alarm objections are usually related to errors in how the as-built drawings were submitted.

Do I need my original fire alarm plans when filing a Post-Approval Amendment (PAA)?

Sprinklers

When are temporary sprinkler loop installations required for review?

Now known as Temporary Core Sprinkler Protection (TCSP), these installations are required when an existing building with five or more consecutive floors is undergoing alterations that will require the sprinkler system to be temporarily disabled.

What is the approval timeline for filing a TCSP application?

Obtaining approval for TCSP typically takes six to eight weeks and involves both the FDNY and the DOB. For more information on the approval process, refer to DOB Issues Memorandum Clarifying New ‘Temp Loop’ Requirements for Existing Buildings.

What is the filing fee associated with TCSP?

The FDNY requires payment of a $200 fee. Additionally, applicants must submit an Application for Modification form “BFP-MOD,” completed and signed by a registered design professional, to the Construction, Demolition and Abatement (CDA) Unit.

When do you need to install a Clean Agent Fire Extinguishing System?

Buildings that store sensitive materials—such as data equipment, intellectual property and art—would benefit from installing a Clean Agent Fire Extinguishing System, which are naturally non-conductive and non-corrosive, leaving no residue behind.

How long is the filing process for installing a Clean Agent Fire Extinguishing System?

The filing process for these systems is complicated and involves multiple agencies. Typical approval time ranges from two to four months. For more information on the filing guidelines, refer to DOB Bulletin # 05-2/2013.

Standpipes

Do all standpipe modifications have to be submitted to the FDNY?

Yes. Once you alter an existing standpipe, you must submit the modifications to FDNY for approval.

To obtain a final Temporary Certificate of Occupancy (TCO), can an affidavit be used in lieu of a letter of approval?

Yes. You can submit an affidavit from a licensed professional in lieu of a Letter of Approval from the FDNY.

At what point during new building construction does the FDNY require standpipe?

Generally, when a building reaches 75 feet in height, the FDNY requires that a standpipe is installed, accessible to the FDNY.

Fire Protection Plans

Does my building require a Fire Protection Plan (FPP)?

Buildings consisting of six or more stories or that are at least 75 feet in height require a Fire Protection Plan to secure a Temporary Certificate of Occupancy (TCO) or to renew an existing one.

Does the FDNY charge a fee for reviewing FPP applications?

Yes. As of January 1, 2016, the FDNY requires a $420 FPP application fee, accompanied by a TM-1 form and a check payable to the “Fire Department City of New York.”
