On October 16, 2017, Mayor Bill de Blasio signed Local Law 196 of 2017, previously referred to as Intro. 1447. Local Law 196 requires workers and supervisors at certain construction sites receive safety training. Refer to this DOB notice for clarification on workers who require and do not require Construction Safety training.
The safety training requirements will be phased-in in three parts. When fully phased-in in 2019, it will require that workers at certain job sites receive a minimum of 40 hours of safety training and supervisors at certain job sites receive a minimum of 60 hours of safety training.
As of the beginning of this month, permit holders are required to maintain a daily log that identifies each construction or demolition worker and supervisor (including construction superintendents, site safety coordinators, site safety managers, concrete safety managers or competent persons) on the construction site and their proof of training. Permit holders must use the log form created by the DOB. A physical or digital copy of log must be maintained and provided to the DOB upon request.
Permit holders must also maintain a copy of each worker’s site safety training (SST) card, SST supervisor card, limited SST card, temporary SST card, or OSHA 10 or 30 card.
Department of Buildings (DOB) permit applicants must certify that workers on site working under permit have the required training. If the DOB discovers untrained workers at a construction site, the Department will issue a violation with civil penalties that go as high as $5,000 per untrained worker to the owner of the site, the permit holder and the employer of the untrained worker. Failure to maintain the daily log and/or a copy of each worker’s SST or OSHA card, or to produce the log upon request by the Department, may result in a fine of at least $2,500.
