Code Question: Which Building Code Applies to My PA Permit?

As many of you know, the New York City Building Code is constantly changing. With these changes, it can be difficult to remember which code governs your specific project. A Place of Assembly (PA) application is no exception.

The Key: When was the building constructed?

When filing a PA for an existing building, the PA must comply with the code in effect at the building’s original design and construction. If the building is new, the PA must comply with the 2014 Building Code.

However, if the building was erected prior to the 2008 Building Code, you will likely need to comply with the 1968 Building Code requirements. If the building was built under the 2008 Building Code, the 2014 Code will be in effect, as the 2008 Code is no longer applicable.

Always an exception…

Lastly, the 2014 Building Code allows an exception to the above rule. If the 2014 Building Code is more favorable for your project in a 1968 code building, and an approved determination is obtained from the Department of Buildings’ Borough Commissioner’s Office, the 2014 Building Code can be used. The determination request must include a comparative analysis of the life safety requirements outlined in both codes (1968 vs. 2014) and prove that the 2014 building and design provisions do not reduce fire and life safety of the building for the proposed use and load.
